Changes for Online Retailers in CZ

In May 2019 the EU adopted a legislative package comprising a directive on contracts for the supply of digital content and services (Digital content directive) and a directive on contracts the sales of goods (Sales of goods directive). The implementation of these directives into the Czech law, which is expected in 2021, will have profound impact on online retailers carrying business in the Czech Republic. For instance, the sellers will become liable to consumers also for “digital content” of goods even when provided by third parties. Also, any lack of conformity of goods which would become apparent within one year of the time when the goods were delivered shall be presumed to have existed at the time when the goods were delivered. Under the previous regulation this period was 6 months.
